Naples, FL – The Firm’s Personal Injury Litigation Practice recently delivered justice for a client by reaching a $400,000 settlement with a condominium association for injuries sustained from a slip & fall.

In the summer of 2015, our client and her family were planning on enjoying a barbeque in the common area of their condominium complex.  The stairs outside of her second floor condo were wet because of a leaking rain gutter that was situated directly above the stairs.  As our client made her way down the stairs to begin setting up for the barbeque, she slipped and fell down the rest of the stairs causing her to suffer serious injury to her neck and spine. She was transported to the emergency room and subsequently had surgery to her neck, where surgeons had to access her spine from the front of her neck and replace a ruptured disc that was compressing the client’s spinal cord. To make matters worse, our client previously reported the faulty gutter to the association but the issue was ignored.

Due to the condo association’s negligence, Kanner & Pintaluga’s personal injury trial team, led by Howard Kanner, filed suit. After more than five years of litigation, during which the condo association consistently asserted that the fall was our client’s fault for not paying attention to her surroundings, the case reached the top of the trial docket.  With trial attorney Berkin Aslan prepared to try the case, the condo association accepted our client’s settlement demand of $400,000 the Friday before jury selection started.
