In 2017, our client was visiting an upscale burger restaurant with her granddaughter when the aluminum chair she sat on collapsed beneath her, causing her leg to twist and become pinned under the weight of her body. As a result of her injuries, our client required a knee replacement surgery and extensive rehabilitation.

Led by Partner Joseph Abdallah, our litigation team discovered that a necessary structural component of the chair was missing which caused the chair’s failure. This important structural component should have been detected by the employees of the burger restaurant when stacking and unstacking the chairs on a daily basis. Expert analysis revealed that the metal support was missing for an extended period of time and had either fallen off or forcibly removed and discarded. Moreover, the burger restaurant offered no training or policies to its employees regarding chair safety.

The defense argued that our client’s injuries were pre-existing and unrelated to the injury sustained in this incident. Our client’s treating physician, a well-respected and reputable physician, opined that our client’s knee replacement was accelerated as a result of the injury she sustained while eating at the burger restaurant. After years of litigation and with the case approaching the doorstep of trial, the parties were able to resolve the case for 300,000.
