Sumter County, AL – The Firm’s Alabama Personal Injury Practice recently settled a motor vehicle case for the $1,050,000 uninsured policy limits.

In November of 2021, our client was struck head-on by a driver traveling on the opposite side of the road at highway speeds. Due to the severity of impact, the defendant driver was pronounced dead at the scene and our client was left with a litany of injuries including a right hip and left wrist fracture both requiring surgical intervention. Our client was forced to embark on an arduous course of physical and mental rehabilitation with noted impairments on activities of daily living and an inability to perform routine occupational duties as a truck driver.

While a coverage investigation ultimately revealed no applicable liability coverage for the deceased, fortunately our client maintained a sizeable policy of Uninsured Motorist coverage. Through the efforts of the Alabama Personal Injury Team, a comprehensive demand was presented accounting for all hospital care, therapy, mental health counseling, and orthopedic surgeries. In addition, a plan was devised for medical costs projection of our client’s future needs as well as a supplemental demand for lost wages and missed job opportunities all attributed to the uninsured’s negligence.

While the uninsured carrier initially balked at the policy limits demand, Partner James Kamensky successfully illustrated our client’s past pain and suffering as well as specific requirements for future medical treatment and lost earnings and the full policy was ultimately tendered.
