In September 2017, in the aftermath of Hurricane Irma, our client filed a claim with his condominium association and their insurance company for property damages to his condominium. As a result of the negligent maintenance and repair of the condominium association’s roof and common elements, our client sustained substantial damages to the interior of his condominium.

Relying on their board of directors, property managers, a team of engineers, contractors, and adjusters along with citing that the roof was the responsibility of our client, the condominium association and its insurance company denied the claim and no payment was issued to our client. Following the denial, our client then attempted to resolve the matter pre-suit in an effort to settle the claim. Again, the claim was denied and he was offered nothing. Left with no other option, our client filed suit in Miami-Dade County.

After extensive litigation with the condominium association and their insurance company, Kanner & Pintaluga attorney, Ardalan Montazer, was able to obtain a full roof replacement of our client’s condominium’s roof-at the expense of the condominium association and negotiate a $698,500 settlement for our client.
