Verdicts & Settlements: $800,000 Settlement Reached in Rear-End Crash

Fort Lauderdale, FL – The Firm’s Personal Injury Litigation Practice recently settled a personal injury case stemming from an automobile rear-end collision where the defendant driver was driving with a known medical condition.

In October 2014, our client was approaching a red light and slowed to a near stop on her morning drive to work. The Defendant, who was driving behind our client in a company vehicle, was diagnosed years before the crash with a heart condition called Postural Orthostatic Tachycardia Syndrome (POTS). That condition often caused her to feel lightheaded and faint, among other symptoms. A vehicle computer download proved that Defendant crashed into our client’s vehicle at over 45 miles per hour. The force of the impact caused our client permanent injuries, including the need for a cervical fusion. The Defendant had little to no recollection of the events leading up to the crash.

After putting the pieces of the story together, Kanner & Pintaluga’s trial team led by Partner Joseph Abdallah sought and obtained, over Defendants’ objections, information and documents about the medical history of the Defendant. The medical records told the whole story – that the crash was caused as a result of the Defendant’s known medical condition, POTS. After presentation of this evidence to the Court, the Court granted Plaintiff’s Motion for Leave to Amend her Complaint to allege a claim for punitive damages against the Defendant-driver for driving with a known medical condition that could cause her to lose consciousness behind the wheel of a vehicle.

With the mounting evidence that the Defendant should not have been driving when the crash happened, Defendants agreed to a settlement of $800,000 to resolve the damages caused by the crash.
