Verdicts & Settlements: Townhome Trip & Fall Case Settled for $525,000

Palm Beach, FL – Kanner and Pintaluga’s Personal Injury Litigation attorney recently resolved a trip and fall case for $525,000

In December 2014, our client was visiting her relative at a private residential townhome complex in Palm Beach County, Florida. Shortly after parking her car nearby her relative’s home, she tripped and fell over an open and exposed water drain located on the street. As a result of her fall, our client sustained injuries to her right knee, neck, and back, which had also caused her medical problems before her fall. Ultimately she treated with orthopedists, underwent injection therapy and later had surgery.

Kanner & Pintaluga’s trial team, led by Howard Kanner, brought suit against the residential complex where the fall occurred. Plaintiff was required to prove that her injuries were caused by her trip and fall, and that Defendant knew or should have known about the open and exposed water drain prior to the incident. Defendant fought these allegations and liability, causation of injuries, and damages were all heavily disputed by the Defendant. Defendant alleged that Plaintiff was to blame for the incident and that her injuries were not proximately caused by the fall. The Defendant also alleged another entity was responsible for the maintenance of the area where Plaintiff tripped and fell.

After years of litigation and extensive negotiations up until just days before trial was to begin, trial attorney Matthew Levy was able to help persuade Defendant to accept Plaintiff’s monetary demand to resolve the case for $525,000.
