Verdicts & Settlements: $972K Jury Award, Upheld by Fla. 4th DCA, Finally Resolved

Boca Raton, FL – A nearly $1 million judgment for serious injuries sustained by our client almost a decade ago has been finally resolved.

During a hospital visitation trip, our client slipped and fell on a substance that had accumulated near the exit of the hospital gift shop and not timely cleaned up.  The resulting injuries caused our client to undergo multiple knee replacement surgeries and an Achilles’ tendon surgery.  Due to the hospital’s failure to resolve the matter, Kanner & Pintaluga’s personal injury trial team, led by Howard Kanner, initiated a lawsuit against the Hospital in June 2012.

Six years after the initial suit was filed, and after numerous conversations with the Hospital to settle the dispute, the Hospital only offered $7,500.  Without a reasonable offer, trial was the best and only way to hold the Hospital accountable. A jury subsequently found that the Hospital was 100% responsible for the injuries sustained and awarded our client $623,000.  In addition to the verdict, the Court granted our client entitlement to recover attorneys’ fees which amounted to more than $250,000.

Despite years of litigation, the Hospital still refused to accept the Court’s award and appealed the case to The Florida Fourth District Court of Appeal.  Rather than referring the case to another firm to handle the appeal, which many firms do, it was handled in-house by our highly experienced appellate team, led by Blair Dickert. On August 20, 2020, The Fourth District affirmed, per curiam, the trial Court’s verdict and final judgment was entered in favor of our client for the full amount awarded plus interest and costs for a total of $972,374.93.  This week, after nine years of litigation and appeals, our client finally received the justice she rightfully deserved.

The case is Edwina Egnak-Barnes v. Boca Raton Regional Hospital, Inc. case number 50-2012-CA-007738, in the Circuit Court of the 15th Judicial Circuit, Palm Beach County, Florida.
