Boca Raton Rear-End Collision Lawyers

Read-end collisions are the most prevalent type of auto accident and account for roughly 29 percent of all car accidents in the U.S. It’s one of the easiest accidents to get into because you may not even be aware it’s happening. A common scenario is a driver accidentally lets up on the brake while stopped at a light and bumps into the car ahead of them. Even at a low speed, the property damages and physical injuries in a rear-end collision can be severe.

The risk of victims experiencing whiplash – or an injury caused by the sudden whipping motion of the neck due to a sudden change in direction or speed – can be high, especially when you’re struck from behind with significant force.

In severe cases, a whiplash injury can even affect your ability to walk, perform everyday tasks or work. Concussions are also common in rear-end collisions. Any brain injury poses a serious risk to your ability to think and function properly. A minor concussion might only leave you foggy for a few days, but more severe traumatic brain injuries can lead to permanent cognitive decline.

If you’ve suffered an injury in a rear-end collision in Boca Raton, it may be in your best interest to consult with a car crash lawyer. The experienced lawyers at Kanner & Pintaluga are here to help.

Who Is Typically at Fault in a Rear-End Collision?

In almost all personal injury claims, it’s the car that collides from behind that’s at fault. They have the burden of proof to try and prove otherwise. While this is usually beneficial to plaintiffs, there are some scenarios where the rear car driver was the victim instead.

For example, if the car ahead of them suddenly slams on their brakes without a clear reason, and you crash into them, you shouldn’t be the one at fault. Unfortunately, it’s now your responsibility to prove that’s what happened. The other party may try to claim that you were tailgating or distracted, saying whatever they need to deny liability.

If you’re the rear driver in this scenario and suffered severe injuries, the Boca Raton car crash lawyers at Kanner & Pintaluga can help investigate your case. We’ll take a detail-oriented approach to look for evidence that shows the other driver’s negligence and your innocence, including witness testimony, surveillance footage, driving records and more to clear your name.

What You Should Know About Your Auto Insurance

Liability in a rear-end collision is relatively straightforward, although fault is anything but in Florida. Because Florida is a no-fault insurance state, you need to seek compensation for medical bills and lost wages through your legally mandated personal Injury protection (PIP) insurance before you pursue damages from the other driver – even in clear-cut fault cases like rear-end collisions.

Since you don’t have to prove fault, PIP insurance can sometimes help you receive compensation quicker. Unfortunately, it tends to not be enough. PIP only reimburses up to 60 percent of lost wages and 80 percent of medical bills up to your policy limit – a minimum of $10,000. This amount is often nowhere near enough after serious injuries, leaving victims struggling to pay the remainder if they’ve sustained a severe injury or disability.

PIP also doesn’t cover pain and suffering damages, so you won’t be compensated for the ongoing physical pain or emotional trauma you’ve experienced without pursuing the at-fault driver for compensation.

Moreover, even with no-fault insurance capping the amount of compensation you can receive, your insurance provider may still try to give you even less by downplaying your injuries or denying responsibility.

There are ways you can increase your total reimbursement, depending on your circumstances. If the other driver wasn’t insured and your policy includes uninsured or underinsured motorist coverage, you could possibly receive compensation from that as well as from PIP.

Most importantly, there are many situations where you can still sue the other driver or file a claim against their insurance if they do have bodily injury liability coverage. If they don’t have liability coverage, which isn’t required by law in Florida, you may still be able to pursue compensation via their assets.
