Verdicts & Settlements: $250,000 Policy Limits Tendered in T-Bone Crash

Boca Raton, FL – The Firm’s Personal Injury Litigation Practice recently settled an automobile accident case for the Defendant’s policy limits of $250,000.

In September 2018, our client was on her way to work when a negligent driver, out of nowhere, left a shopping plaza and attempted to cross three lanes of traffic. Unfortunately, she never saw our client, violated her right of way, and T-boned her.

Everyone has the right to expect drivers will wait until it is safe to enter the roadway to prevent crashes and protect everyone from injury or death. When simple rules like this are broken, the consequences can be life-changing. As a result of the Defendant’s actions, our client suffered significant injuries including a broken wrist that required surgery and implants and severe injuries to her neck. The impact was so severe that our client suffered multiple herniations in her neck that were putting pressure on her spinal cord and according to medical experts would require future surgery.  Due to our client’s age (21), she was deemed too young to undergo the surgeries now. This meant that our client would be trapped in her body until a doctor thought it was safe enough to correct these injuries.

To make matters worse, the Defendant’s insurance company not only refused to accept responsibility for their insured’s actions (attempting to shift the blame for the crash to our client), but also refused to appreciate the new reality their insured put our client in. Unable to settle the case pre-suit, Kanner & Pintaluga’s personal injury trial team, led by Howard Kanner, immediately filed suit. Exactly a year from the date the complaint was filed, trial attorney Mina Grace was able to convince the insurance company to tender the policy limits of $250,000.
