Verdicts & Settlements: $1.1 Million Settlement Reached for Client Involved in Distracted Driver Crash

Boca Raton, FL – The Firm’s Personal Injury Litigation Practice recently achieved a $1.1 million settlement for injuries sustained as a result of a distracted driver crash.

In June 2014, our client was driving through an intersection on a green light when an inexperienced, distracted driver ran a red light, colliding into the passenger side of his vehicle. The defendant struck our client at full-speed, exerting more force on his back than four grown men pressing down on his spine, causing life-long, permanent injuries. Following the crash, our client was rushed to the hospital and required multiple surgeries and was unable to continue working due to his physical limitations.

The defense’s medical experts claimed that our client’s injuries were pre-existing and unrelated to the crash. However, his work history and medical records told a different story. Before the crash, our client was a hard-working journeyman, who never had any restrictions or limitations with his work. His prior back complaints were minor and similar to those symptoms any middle-aged man might experience. Receiving no pre-suit settlement offer, Kanner & Pintaluga’s personal injury trial team, led by Howard Kanner, filed suit.

The defense then hired a litigation nurse consultant who asserted that the medical bills incurred were higher than what many other doctors in the area charge for the same medical treatment. However, after fully investigating the sources defendant’s expert relied upon and how she reached her opinion, it was clear that her opinions and testimony were unreliable. Shortly before the trial was to begin, Senior Trial Attorney, Joseph Abdallah convinced the Judge that her opinions were unreliable and the Court ultimately did not permit the defense’s expert to offer opinions about the medical bills at the trial.

With the trial looming, the defense accepted our client’s settlement demand of $1.1 million just days before jury selection was to begin.
