As long as you\u2019re a legal guest or customer, you have a right to safety.<\/p>\n<p>If there are hazards present on a property, the property owner or manager must provide adequate warning to ensure you know about the risk so you can safely avoid injury.<\/p>\n<p>It\u2019s not uncommon for property owners to fail to uphold this duty, which can result in people suffering slip and fall injuries, electrocution injuries, tripping injuries or other health complications.<\/p>\n<h4><strong>In order to win a premises liability or slip and fall case, a plaintiff needs to be able to prove:<\/strong><\/h4>\n<ul>\n<li>The defendant had a duty to the injured person (the plaintiff was on the property legally and was owed a legal duty of care)<\/li>\n<li>The defendant failed to uphold that duty (they knew about a hazard but failed to address it or warn people on the property in a timely fashion)<\/li>\n<li>The plaintiff suffered an injury as a result of that failure<\/li>\n<\/ul>\n<p>The catch here is often in the knowing of the danger.<\/p>\n<p>For example, if a shopper slips and falls in a puddle they just created in a grocery store, the grocery store would likely not be liable.
